LG Mobile Phone Sweepstakes Official Rules

OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA WHO ARE AGE 18 OR OLDER AND LOCATED IN THE U.S. AT THE TIME OF ENTRY. VOID WHERE PROHIBITED BY LAW. NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

  1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. LG Mobile Phone Sweepstakes (the "Promotion") is open only to legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older. Employees, contractors, directors and officers of LG Electronics MobileComm U.S.A., Inc. ("Sponsor"), and its parent, subsidiaries and affiliated companies, distributors, retail stores, and the advertising, fulfillment, judging and promotion agencies involved in the development and administration of this Promotion [(including 360 Digital Influence a division of Ogilvy Public Relations Worldwide ("Administrator")], together with Sponsor, collectively, "Promotion Parties"), and their immediate family members (parent, child, sibling and spouse of each) and those individuals living in their household are not eligible. The Promotion is subject to all applicable federal, state, and local laws and regulations. Void where prohibited or restricted by law. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.
  2. SPONSOR. The Promotion is sponsored by LG Electronics MobileComm U.S.A., Inc., 10101 Old Grove Road, San Diego, CA 92131.
  3. TIMING. The Promotion consists of 13 Promotion Periods and the Periods will begin and end on the following dates (with the final Promotion end date October 27, 2009) (Administrator's computer is the official time keeping device for the Promotion).

    Promotion Period 1
    will begin on April 29, 2009 at 12:00:01 am ET and end on May 12, 2009 at 11:59:59 pm ET.

    Promotion Period 2
    will begin on May 13, 2009 at 12:00:01 am ET and end on May 26, 2009 at 11:59:59 pm ET.

    Promotion Period 3
    will begin on May 27, 2009 at 12:00:01 am ET and end on June 9, 2009 at 11:59:59 pm ET.

    Promotion Period 4
    will begin on June 10, 2009 at 12:00:01 am ET and end on June 23, 2009 at 11:59:59 pm ET.

    Promotion Period 5
    will begin on June 24, 2009 at 12:00:01 am ET and end on July 7, 2009 at 11:59:59 pm ET.

    Promotion Period 6
    will begin on July 8, 2009 at 12:00:01 am ET and end on July 21, 2009 at 11:59:59 pm ET.

    Promotion Period 7
    will begin on July 22, 2009 at 12:00:01 am ET and end on August 4, 2009 at 11:59:59 pm ET.

    Promotion Period 8
    will begin on August 5, 2009 at 12:00:01 am ET and end on August 18, 2009 at 11:59:59 pm ET.

    Promotion Period 9
    will begin on August 19, 2009 at 12:00:01 am ET and end on September 1, 2009 at 11:59:59 pm ET.

    Promotion Period 10
    will begin on September 2, 2009 at 12:00:01 am ET and end on September 15, 2009 at 11:59:59 pm ET.

    Promotion Period 11
    will begin on September 16, 2009 at 12:00:01 am ET and end on September 29, 2009 at 11:59:59 pm ET.

    Promotion Period 12
    will begin on September 30, 2009 at 12:00:01 am ET and end on October 13, 2009 at 11:59:59 pm ET.

    Promotion Period 13
    will begin on October 14, 2009 at 12:00:01 am ET and end on October 27, 2009 at 11:59:59 pm ET.
  4. HOW TO ENTER. Enter the Promotion online at http://www.lge.com/us/mobile-phones/DTXTR.jsp. Each entrant may fill out (1) official entry form which asks for entrant's first and last name, email address, Date of Birth and phone number ("Entry Form"). Limit one (1) entry form per person per each Promotion Period. Entries will not be carried forward for subsequent Promotion Periods, if any. Those wishing to participate in subsequent Promotion Periods (if any) must submit a new Entry Form for each Promotion Period.
  5. NUMBER OF WINNERS: There will be a total of one (1) winner ("Winner") per Promotion Period, for a total of 13 Winners.
  6. WINNER SELECTION: One Winner per Promotion Period will be selected from among all eligible entries per Promotion Period in random drawings to be conducted by Administrator's designated representatives. Random drawings will be conducted on or about 15 days after the conclusion of each Promotion Period. Odds of winning depend on the number of eligible entries received per Promotion Period. Entries will not be carried forward for subsequent Promotion Periods. Potential Winners will be notified by email or telephone. Winner notification returned as undeliverable may result in prize forfeiture and an alternate winner shall be selected via a random drawing of the remaining eligible entries received per Promotion Period. The potential Winners may be required to sign and return an affidavit of eligibility and release of liability within ten (10) business days of notification. In the event of non-compliance within this time period, an alternate winner will be selected in a random drawing from remaining eligible entries received per Promotion Period. Sponsor reserves the right to send the prize to a Winner directly without such a release from liability, however, acceptance of the prize by a Winner shall be deemed acceptance of all of the terms and conditions of these Official Rules. Sponsor is not responsible, and may disqualify an entrant, if the entrant's email or phone number provided does not work or is changed.
  7. PRIZES. Thirteen (13) prizes will be awarded in total (one per Promotion Period). One (1) Winner per Promotion Period will receive one (1) LG enV2 mobile phone prize with an Approximate Retail Value ("ARV") of $279.00 or one (1) LG Lotus mobile phone prize with an ARV of $299.00. Phone model to be awarded will be determined in Sponsor's sole discretion. Entrants understand that phone models may only operate on certain carrier networks, which may or may not be compatible with entrant's existing network, if any. Requests for phones compatible with a potential winner's existing network cannot be accommodated. No substitution or transfer of a prize is permitted except by Sponsor in its sole discretion. In the event Sponsor is not able to provide the advertised prize for any reason, Sponsor reserves the right to provide a substitute prize of equal or greater value. The ARV of the prize represents Sponsor's good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Winner is responsible for all federal, state, local, and any other taxes and fees associated with prize receipt, including all operating, usage and activation charges that may be required to set-up and/or use the prize.
  8. GENERAL CONDITIONS: By participating, entrants agree to these Official Rules, Sponsor's Privacy Policy and to the decisions of the Promotion Parties, which are final and binding in all respects. If for any reason the Promotion is not capable of running as planned, including infection by virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right, at its sole discretion, to cancel, modify or terminate the Promotion and award applicable prizes from all eligible entries received prior to termination. Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the Promotion. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. SPONSOR'S FAILURE TO ENFORCE ANY TERM OF THESE OFFICIAL RULES SHALL NOT CONSTITUTE A WAIVER OF THAT PROVISION.
  9. RELEASE: By receipt of any prize, Winner agrees to release and hold harmless the Promotion Parties and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of any and all liability for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury and/or death which may occur in connection with, preparation for, travel to, or participation in the Promotion, or possession, acceptance and/or use or misuse of prize or participation in any Promotion-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Entrants agree to indemnify Sponsor for any unauthorized use or misuse of or modification to the prizes. Entrants who do not comply with these Official Rules, or who attempt to interfere with this Promotion in any way shall be disqualified.
  10. PUBLICITY: Except where prohibited and in Tennessee, participation in the Promotion constitutes each Winner's consent to Sponsor's and its agents' use of Winner's name, likeness, photograph, voice, opinions and/or biographical information including without limitation, hometown and state for promotional purposes in any and media now known or hereinafter invented, worldwide, including, without limitation, providing third parties with the winners list as provided for in the Rules below, without further payment or consideration.
  11. LIMITATIONS OF LIABITLITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (2) technical failures of any kind, including, but not limited to technical, hardware, software, telephone (including wireless devises and/or handsets) or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error which may occur in the administration of the Promotion or the processing of entries; (5) late, lost, undeliverable, damaged or stolen entries; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt or use or misuse of any prize. If, for any reason, an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Promotion, provided that, if it is not possible to award another entry due to discontinuance of the Promotion, or any part of it, for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein.
  12. DISPUTES: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in San Diego County, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
  13. ENTRANT'S PERSONAL INFORMATION: The information collected from entrants is subject to the Sponsor's Privacy Policy (http://www.lifewithlg.com/privacy.aspx).
  14. WINNERS LIST REQUESTS: For a Winners List, available after November 30, 2009, mail a self-addressed, stamped envelope to:
